In consideration of The Axe Factor - Axe Throwing, furnishing services and/or equipment to enable me to participate in axe throwing, smash room and or golf simulator, I agree as follows:

I fully understand and acknowledge that:

(a) risks and dangers exist in my use of axes, hatchets and/or any equipment that is thrown, swung or gripped and my participation in any axe throwing activities or events;

(b) my participation in such activities and/or use of such equipment may result in my injury or illness including but not limited to bodily injury, disease strains, fractures, cuts, partial and/or total paralysis, eye injury, blindness, heat stroke, heart attack, death or other ailments that could cause serious disability;

(c) these risks and dangers may be caused by the negligence of the owners, employees, officers or agents of The Axe Factor - Axe Throwing; the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes. These risks and dangers may arise from foreseeable or unforeseeable causes; and

(d) by my participation in these activities and/or use of equipment, I hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the owners, agents, officers, employees of The Axe Factor - Axe Throwing, or by any other person. 

(e) Personal Responsibility with Alcohol: Consumption of alcohol at events and/or activities including all those listed above or other events held at The Axe Factor is a personal decision. By being involved with any activity on the premises or any and all trailer events, I agree that any alcoholic beverages I consume are my own choice and responsibility. I agree to drink responsibility and heed suggestions from others and will not: throw any axes, or be reckless with any equipment provided by The Axe Factor if I am intoxicated. I acknowledge that I alone am responsible for all of my actions resulting from consuming alcohol and The Axe Factor is in no way responsible.

I, ON BEHALF OF MYSELF, MY PERSONAL REPRESENTATIVES AND MY HEIRS, HEREBY VOLUNTARILY AGREE TO RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, DEFEND AND INDEMNIFY THE AXE FACTOR, LLC AND IT’S OWNERS, AGENTS, OFFICERS, AND EMPLOYEES FROM ANY AND ALL CLAIMS, ACTIONS, OR LOSSES FOR BODILY INJURY, PROPERTY DAMAGE, WRONGFUL DEATH, LOSS OF SERVICES OR OTHERWISE WHICH MAY ARISE OUT OF MY USE OF AXE THROWING EQUIPMENT OR MY PARTICIPATION IN AXE THROWING ACTIVITIES OR EVENTS INSIDE OF THE AXE FACTOR. I SPECIFICALLY UNDERSTAND THAT I AM RELEASING, DISCHARGING AND WAIVING ANY CLAIMS OR ACTIONS THAT I MAY HAVE PRESENTLY OR IN THE FUTURE FOR NEGLIGENT ACTS OR OTHER CONDUCT BY THE OWNERS, AGENTS, OFFICERS OR EMPLOYEES OF THE AXE FACTOR - AXE THROWING, SMASH ROOM AND GOLF SIMULATOR.

MEDICAL PERMISSION AUTHORIZATION

If the participant is of minority age, the undersigned parent or guardian hereby gives permission for The Axe Factor - Axe Throwing, to authorize emergency medical treatment as may be deemed necessary for the child named below while participating in axe throwing. 

I HAVE READ THE ABOVE WAIVER AND RELEASE AND BY SIGNING IT AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE THE AXE FACTOR - AXE THROWING, FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE. 

I further agree that I have read and will adhere to all Safety Rules for the The Axe Factor - Axe Throwing Facility, posted on the wall, and I will follow the instruction of The Axe Factor - Axe Throwing coaches, trainers and/or lane supervisors. I understand that I must wear closed-toe shoes. I understand that as a public facility, pictures and or video may be taken by The Axe Factor - Axe Throwing staff or others, and I grant them the right to publish, and re-publish photographic portraits or pictures of me or in which I may be included, in whole or in part.

I understand that individuals showing any signs of intoxication will not be permitted in the facility. The Axe Factor – Axe Throwing, reserves the right to remove such intoxicated persons from the premises with no refunds.

I agree that violation of any of the The Axe Factor, LLC rules is grounds for immediate expulsion with no refunds.

By hitting accept and/or signing, you are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead which is available at our location. By hitting accept, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
